构建科学合理的自然保护地体系是实现长江流域生态健康和高质量发展的必然要求。各类"自然保护地"所依据的立法从外在形式上看,立法层级较低,统领性、综合性的立法长期处于空白状态;从内在体系上看,过于零散和碎片化,缺乏对自然生态系统整体性规律的考量。根据中办国办《关于建立以国家公园为主体的自然保护地体系的指导意见》的精神,我国重构长江流域自然保护地体系和管理体制机制,可从以下几方面着手:遵循生态系统整体性规律,科学整合现有众多杂乱的"自然保护地";基于一体化流域管理,建立统分结合、整体联动的流域管理体制机制,通过配套法规规章对《长江保护法》涉及自然保护地和湿地的管理体制机制进行完善;推动治理体系现代化,实现多元共治。To construct a scientific and reasonable nature reserves system is an essential requirement to realize the ecological health and high-quality development of the Yangtze River Basin.In terms of external form,the legislation on which all kinds of"nature reserves"are based is at a low level,and the leading and comprehensive legislation has been in a blank state for a long time;in terms of internal system,it is too scattered and fragmented,and lacks consideration of the overall law of the natural ecosystem.According to the Guidelines on the Establishment of a System of Nature Reserves with National Parks as the Main Body issued by the central organs in 2019,in order to reconstruct the nature reserve system and management system and mechanism in the Yangtze River Basin,we can start from the following aspects:following the laws of ecosystem integrity and scientifically integrate so many existing disordered"nature reserves";based on the concept of integrated river basin management,establishing an integrated and linked river basin management institutions and mechanism,and revising the inconsistent and even conflicting provisions of the Yangtze River Protection Law(Draft)involving nature reserves;promoting the modernization of the governance system,and realize the multi-governance.
