我国劳动争议调解程序问题研究

摘要 随着中国经济的快速发展及经济结构的调整,劳动关系的含义更加多样化和复杂化,劳动争议案件数量日益增多。那么,如何最大限度利用调解程序化解劳资矛盾,定纷止争,是当前我们迫切需要思考与解决的问题。我国劳动争议调解程序目前存在的问题主要是仲裁前调解程序作用有限、调解程序不规范、裁诉调解程序不能有效衔接等。为解决上述问题,我国劳动争议调解程序应成立政府主导的劳动争议调解机构,构建协调联动调解机制,规范调解为必经程序,引导调裁诉对接,增强调解程序的实效性,从而使得劳动争议调解程序发挥应有的作用。 With the rapid development of China's economy and the adjustment of economic structure,the meaning of labor relations is more diversified and complicated,and the number of labor dispute cases has reached new heights.How to make the best use of mediation procedures to resolve labor conflicts and settle disputes is an urgent issue for us to think about.The existing problems in China's labor dispute mediation procedures are mainly that the mediation procedure before arbitration is nominal,the mediation procedure is not standardized,and the mediation procedure can not be effectively linked.China's labor dispute mediation procedures should establish a government led labor dispute mediation organization,build a coordinated linkage mediation mechanism,standardize mediation as a necessary procedure,guide the docking of mediation,arbitration and litigation,and strengthen the effectiveness of the mediation process,so as to make the labor dispute mediation procedure play its due role.
