摘要 近年来,O2O租房平台快速发展,迅速占据了中心城市的主要租房市场,在为房东及租客提供更加便捷租房体验的同时,也带来了许多法律问题和法律风险。其中最核心的法律问题有两点,一是平台与房东之间形成的法律关系究竟是委托关系还是租赁关系,二是租客在平台的居间下与银行签订的“租金贷”合同是否应受到平台违约行为的影响。前者关系到当平台出现违约时,应当由哪一方当事人承担由此而引发的不利后果,后者则关系到租客在还款期内可能面临的各种信用风险。 In recent years,with the rapid development of O2O rental platform,it has occupied the main rental market in central cities.While providing more convenient rental experience for landlords and tenants,it has also brought many legal problems and legal risks.There are two core legal issues:one is whether the legal relationship between the platform and the landlord is entrusted legal relationship or leased legal relationship;the other is whether the rent loan between the tenant and the bank under the intermediary of the platform should be affected by the platform's breach of contract.The former relates to which party should bear the adverse consequences of the platform's breach when the rental platform break the contract.The latter is related to all kinds of credit risks that tenants may face during the repayment period.
